After conflicting reports for the past number of weeks, it's now being reported that Rob Van Dam IS STILL under contract with WWE and that the reports of him refusing to sign are false. According to the absolute latest report, Rob Van Dam signed a very unique contract when he returned to WWE a few months ago that allows him to work pretty much at his convenience. He agreed to come back for 90 days and then he's allowed to take as much time off as he wants.
The word going around right now is that Van Dam will probably return in time for the Royal Rumble. WWE officials would then like for him to work until at least the Extreme Rules pay-per-view, which would be more than 90 days between those two pay-per-views.
Van Dam's contract with WWE even allows him to work for independent wrestling promotions, but obviously not major ones such as TNA or ROH.
As far as his status with WWE officials, Van Dam is said to have a good relationship with WWE officials right now and there are talks about doing a Rob Van Dam DVD set some time down the line.
